Appointment Of District Attorney Upon Vacancy
AND NOW THIS 30th day of October, 2023;
WHEREAS, the duly elected District Attorney for Franklin County, Pennsylvania has submitted a letter to the Franklin County Commissioners and the President Judge declaring his last day in office to be October 29, 2023;
AND WHEREAS, Matt Fogal's term of office as District Attorney for Franklin County expires on December 31, 2023;
AND WHEREAS a general election to select the district attorney for a four year term beginning January 1, 2024 is scheduled to be held Tuesday, November 7, 2023;
AND WHEREAS, pursuant to 16 P.S. § 1404 the judges of the court of common pleas shall, upon a showing that the first assistant district attorney satisfies the requirements of section 1401, appoint the first assistant district attorney to fill the office of district attorney and to discharge the duties of the district attorney until the first Monday in January following the next municipal election occurring not less than ninety days after the occurrence of the vacancy.
AND WHEREAS, the First Assistant District Attorney Laura J. Kerstetter was appointed by District Attorney Matt Fogal to serve as First Assistant District Attorney on December 10, 2018 and continues to serve in that role. She has executed an affidavit swearing she complies with the requirements of Section 1401;
IT IS HEREBY ORDERED effective October 30, 2023, Laura J. Kerstetter is appointed District Attorney for Franklin County, Pennsylvania and shall serve as the District Attorney for Franklin County until January 1, 2024, the first Monday in January, 2024.
