5/1/2020 - Sixth Supplemental Emergency Judicial Order through June 1st
Sixth Supplemental Emergency Judicial Order confirming extension of Judicial Emergency through June 1, 2020, and Reconciling the April 27, 2020 Fifth Supplemental Emergency Order with the Pennsylvania Supreme Court Order Dated April 28, 2020
AND NOW this 1st day of May, 2020, in order to reconcile this court's Fifth Supplemental Judicial Emergency Order filed April 27, 2020 with the Pennsylvania Supreme Court's Emergency Order filed April 28, 2020, it is hereby ordered as follows:
The following amendments or modifications of this court's order dated April 27, 2020 shall be as follows:
Paragraph A. is hereby amended to extend the judicial emergency through June 1, 2020.
Paragraph B. is adopted without modification.
Paragraph C. is amended to add that in addition to Magisterial District Judges being enabled to hear all matters on their docket subject to the restrictions set forth therein, they shall be entitled to have constables serve and execute non-appearance warrants.
Paragraph D. is hereby amended as follows: 1. Jury trials are suspended through June 1, 2020. The resumption of the selection of jury trials after June 1st, 2020 shall only be conducted taking into account compliance with prevailing health and safety norms and as maybe be consistent with best practices outlined by the Pennsylvania Supreme Court, Administrative Office of Pennsylvania Courts or their designee. The 39th Judicial District has initiated committees in both counties to review and establish a practice for proceeding and will release its recommendations to the President Judge in adequate time to implement them at the conclusion of the judicial emergency.
Paragraphs E., F. and Gare adopted without modification.
The following provisions are also hereby ordered to occur so as to reconcile any differences between this court's April 27, 2020 and the Pennsylvania Supreme Court's order dated April 28, 2020:
H. The filing deadlines set forth in the Pennsylvania Supreme Court order dated April 28, 2020, are adopted for the 39th Judicial District. Dispossession of Property actions, Landlord-Tenant actions and/or eviction actions are stayed until May 11, 2020 at which time they may resume.
I. In order to provide the public with access, and noting that the court does not have ease of providing live streaming, in the event any person desires to access a court proceeding, he or she shall notify Court Administration of the request so that the court can consider the request to provide access. In the alternative, all proceedings that are recorded by a court stenographer will be made available to be listened to by the public following the proceeding upon a request to Court Administration.
J. All prior administrative orders that revised the schedule of the criminal court docket to accommodate videoconferencing for incarcerated inmates shall be extended through June 1, 2020.
K. Each Magisterial District Court in the 39th Judicial District will develop a set of procedures for the admission of the public, conduct of hearings and receipt of payments consistent with the Pennsylvania Supreme Court order dated April 28, 2020, which shall be posted on the Franklin or Fulton County websites and on the doors of the office to which they apply.
